تسلط هذه الدراسة الضوء على أعمال لجنة حقوق الإنسان في مجلس الأمة الكويتي، والتي تشكلت بقرار من المجلس ذاته في جلسته المنعقدة بتاريخ 24/10/1992 كلجنة مؤقتة تعني بالدفاع عن حقوق الإنسان في الكويت، وتتألف من سبعة أعضاء يتم انتخابهم مع بداية كل دور انعقاد بموافقة مسبقة من أغلبية الأعضاء الذين يتألف منهم المجلس، وتهدف الدراسة إلى بيان دور اللجنة في دعم وحماية حقوق الإنسان بمختلف القضايا والمجالات في الكويت وخارجها، إضافة إلى مواقف أعضاء مجلس الأمة أنفسهم بشكل مباشر تجاه هذه اللجنة، وتستخدم الدراسة الاستبيان كمنهجية علمية في الحصول على المعلومات من خلال الإجابة على الأسئلة الموجهة إلى نواب البرلمان ذاتهم، حيث شارك (40) نائباً (أي ما نسبته 80% من مجموع أعضاء مجلس الأمة) في هذه الدراسة الميدانية، وتوضح النتائج بأن 90% من الأعضاء يعارضون إلغاء لجنة حقوق الإنسان النيابية على الرغم من أن (3) أعضاء فقط (8%) رؤوا أن تأثير اللجنة قوي، في مقابل (28) عضواً (70%) ممن اعتبروا أن تأثيرها متوسطاً، بينما رأى (9) أعضاء (23%) أن تأثيرها ضعيف، ومن جهة اخرى اعتقد (21) عضواً (53%) أن تأثير اللجنة على علاقة المجلس بالحكومة إيجابي، في حين رأى (4) أعضاء (10%) أن تأثيرها سلبي، كما رأت العينة أن اللجنة كانت فعالة أكثر تجاه المشاكل التي تتعلق بالسجون بينما اعتقدوا أن دورها في حل القضايا المتعلقة بالمستشفيات ضعيفاً مقارنة بالمشاكل الأخرى، ويناقش هذا البحث أيضاً نتائج الاستبانة بالتفصيل، كما يطرح مجموعة من التوصيات والمقترحات التي قد تعالج وتحسّن وتنظم أعمال هذه اللجنة البرلمانية المهمة.
Abstract English
"This study sheds light on the work and efforts of the Human Rights Committee in the Kuwaiti National Assembly which
was formed after a decree by the Parliament itself in a parliamentary session dated in October 1992. The temporary
committee was formed to deal with human rights issues in Kuwait. The decree also outlined that the committee consisted of seven members who were elected by the majority of the Assembly members. This study aimed to report on the
role of the committee in maintaining and protecting human rights in and outside of Kuwait and also report the attitudes
of the Parliament’s members toward the committee.
The study employed a survey as a methodology for data collection soliciting response from the parliament’s members
themselves. Forty members participated in the survey, about 80% of the 50 Parliament members. The outcomes
indicated that 90% of the sampled members rejected the elimination of the Committee even though only 3 members
(8%) reported that it had a strong positive impact on human rights issues in Kuwait. Other members, 28 (70%), thought
that the influence of the Committee was moderate while only 9 members (23%) thought it was weak. Also, 21 (53%)
members believed that the committee’s impact on the relationship between the Parliament and the Kuwaiti government
was positive while 4 members (10%) believed it was negative. Finally, the majority of respondents thought that the
Committee was effective in dealing with issues and problems related to prisons in Kuwait while its role in dealing with
issues related to hospitals, in comparison to other issues, was weak and limited.
The research discusses the outcomes of the study and provides suggestions and recommendation that may improve
the performance and organization of the committee."
