The Legislative Framework of Utilizing the Oil Fields of North Kuwait

النفط لا يزال هو المادة الأساسية التي تدخل في كثير من الصناعات المختلفة الأمر الذي يجعل له أهمية كبيرة على المستوى الدولي و أحد الأسباب الرئيسية لوجود المصالح الاقتصادية بين الدول المتقدمة والدول المنتجة للنفط. و بسبب عدم القدرة الإنتاجية لدولة الكويت بسبب عدم قدرة الكوادر الفنية الوطنية لاستثمار الثروات النفطية الأمر الذي جعل الدولة غير قادرة على تلبية الطلب المستقبلي المتوقع على النفط مما يساهم في سد حاجات الأسواق النفطية العالمية بالإضافة إلى تنمية احتياطيات النفط بالدولة والحفاظ على سمعتها ومكانتها المرموقة بين الدول المنتجة للنفط تقدمت الحكومة الكويتية بمشروع قانون خاص لتنظيم الاستعانة بالشركات الأجنبية في مجال تطوير الحقول النفطية. وبعد تقدم الحكومة بمشروع القانون المشار إليه، نشأة في الساحة القانونية والسياسية والاقتصادية في الدولة كثير من الجدل الفكري لذلك ونظرا لأهمية الموضوع ستركز الدراسة على أفضل النظم القانونية لاستغلال الحقول النفطية بصفة عامة وحقول الشمال بصفة خاصة وهو الموضوع الذي أخذ نقاشا واسعا بين رجال السياسة والقانون والاقتصاد في دولة الكويت وما زال النقاش مستمرا حتى الآن بهدف التوصل إلى النظام القانوني الأمثل لاستغلال حقول الشمال في المرحلة الراهنة بما لا يتعارض مع القواعد الدستورية والقانونية في دولة الكويت.

And because of the inability of producing oil in the State of Kuwait because of lack of national technical worker spot in investing of natural resources the why that make under developed countries unable to a complies with an expected future demand of the petroleum from what it takes part in a need plugging of the petroleum market with them universality is in addition to development of the reserves of petroleum by state and preserving reputation and its notable standing preceded Kuwaiti government by a project of special act between produced states for Organization of the seeking of help from by foreign companies in a development of the petroleum field. After the government’s proceeding of the said legislated Code, economic, political and legal agreement grow up in the country. Thus, and because of the important of this subject the study will focus on the best legal system for exploitation of oil fields in general and the north fields specifically. The subject that is talked large debate between political, legal and economic people in the state of Kuwait and stile the debate running until now in order to reach ideal legal method for exploitation of north fields.
